What is the IDX?

Crater Lake Realty, Inc. uses the IDX system to display listings on our websites. The listings “swept” from our Southern Oregon Multiple Listings Service into this Internet Data Exchange system belong to all participating brokers, not just those listed by Crater Lake Realty, Inc. This means that the information displayed has been uploaded by the individual brokers who listed the property. Only those brokers that have agreed to allow other brokers to represent buyers for their listings are allowed to participate in the MLS and IDX.

Digital Millennium Copyright Act (“DMCA”)

CRATER LAKE REALTY, INC. respects the intellectual property rights of others and expects you to do the same. Per the DMCA, CRATER LAKE REALTY, INC. will respond expeditiously to claims of copyright infringement on the Site if submitted to CRATER LAKE REALTY, INC.’s Copyright Agent as described below. Upon receipt of a notice alleging copyright infringement, CRATER LAKE REALTY, INC. will take whatever action it deems appropriate within its sole discretion, including removal of the allegedly infringing materials.

In the event that the material has been uploaded by a broker contracted with CRATER LAKE REALTY, INC. , and CRATER LAKE REALTY, INC. removes the allegedly infringing materials, CRATER LAKE REALTY, INC. will immediately notify the person responsible for posting such materials that CRATER LAKE REALTY, INC. removed or disabled access to the materials. CRATER LAKE REALTY, INC. may also provide the responsible person with your e-mail address so that the person may respond to your allegations.

CRATER LAKE REALTY, INC. reserves the right to terminate, limit or suspend any user’s access to the Site in the event of repeated infringing activity. If you believe that a user of this Site is a repeat infringer, please follow the above instructions to contact CRATER LAKE REALTY, INC.’s Copyright Agent. Please include sufficient information to assist CRATER LAKE REALTY, INC. in determining that the user repeatedly engaged in infringing activity.

Termination

You may stop using the Site at any time. CRATER LAKE REALTY, INC. may suspend or terminate the Site at any time at CRATER LAKE REALTY, INC.’s discretion and without notice. CRATER LAKE REALTY, INC. may also terminate, limit or suspend your access to the Site for any reason at any time and without notice. For example, CRATER LAKE REALTY, INC. may terminate your access to this Site if you are not complying with these Terms or if CRATER LAKE REALTY, INC. determines that you are a repeat infringer (such as downloading or copying and using information from the site for your own purposes) of third-party intellectual property rights.

Some jurisdictions do not permit the limitation or exclusion of certain liabilities, so the above limitations and exclusions may not apply to you.

Modifications

CRATER LAKE REALTY, INC. may modify these Terms from time to time. Any modifications to the Terms will be effective once posted to the Site. If you access or use the Site after the Terms have been modified, your continued access and use will constitute acceptance of all modifications.

This Site includes links to websites that are not owned or operated by CRATER LAKE REALTY, INC. These links are provided as a convenience and do not constitute CRATER LAKE REALTY, INC.’s endorsement of the linked-to website or its owner. Please be aware when you leave the Site because CRATER LAKE REALTY, INC.’s Terms and Privacy Policy will no longer apply to your activities.
